Temporary workers and travel tax relief

We have now had a chance to read and digest the discussion document issued by HMRC yesterday, on Employment Intermediaries: Temporary Workers – relief for travel and subsistence expenses.
We think that this document represents what could be a turning point in our industry and this must be welcomed.
It’s good to see that those in Westminster have acknowledged that there are providers who are fully compliant, who provide a valuable service to the UK’s flexible workforce, and likewise there are less scrupulous organisations who will exploit any loophole and also exploit workers’ ignorance of the law. It is these latter companies that represent the biggest threat to the Exchequer. We should not all be tarred with the same brush and the document appears to be a first step towards tackling this.
The document makes a number of suggestions to make things more “fair” for workers who are not able to claim expenses for travelling to work. It is important for HMRC to ensure that it does not disadvantage workers who have made a conscious decision to waive their job security and perhaps travel long distance to provide a service that is in demand by industry. These people are not the same as permanent employees and it is our view that they should not be treated as such.
We are looking forward to being an active participant in the consultation process and hopefully we will get our first sights of the Level Playing Field that many of us have been working towards.
